CLEARVIEWLED WARRANTY (SALE OF GOODS)

  1. CLEARVIEWLED PTY LTD (Seller) warrants that LED Lights (Product) is free from defects in workmanship and materials for a period of 2 (two) years from the date of purchase.
  2. Subject to clause (3), if the Product fails to operate for any reason within the warranty period and the Product is returned to the place of purchase at the Buyer’s expense, the Seller will repair within a reasonable time, or replace the unit free of charge at CLEARVIEWLED’S discretion.
  3. The warranty referred to in clause (1) is subject to the following conditions:
    1. The Product must be returned to the retailer with proof of purchase.
    2. The Product must not have had its serial number removed, defaced or changed, its casing open, its power cord altered, nor have been tampered with in any other way.
    3. Failure of the product must not be due to misuse, improper installation, connection to the wrong voltage or other abuse or misuse.
    4. The Seller will not be responsible for damage or loss caused during shipping.
    5. Apart from any consumer guarantees under chapter 3, part 3-2, division 1 of the Australian Consumer Law and any other statutory consumer guarantees that cannot be contracted out of, all other warranties express or implied and whether arising by virtue of statute or otherwise are excluded.
    6. The Buyer must follow all instructions provided in the Product manual for installation, use, and maintenance. Failure to do so may void this warranty. The Seller reserves the right to request evidence of proper installation and use before honouring any warranty claim.
    7. The Seller’s liability under this warranty is limited to the repair or replacement of the defective Product, or the refund of the purchase price, at the Seller’s sole discretion. The Seller shall not be liable for any consequential, indirect, or incidental damages arising from the use or inability to use the Product.
    8. The warranty period shall commence from the date of delivery to the Buyer and shall be valid for 24 months, unless otherwise specified in writing by the Seller. Any repair or replacement under this warranty does not extend the original warranty period.
    9. The Seller reserves the right to determine whether a Product is faulty due to manufacturing defects or customer misuse. In cases of dispute, an independent third- party assessment may be conducted at the Buyer’s expense, which will be refunded if the Product is found to be faulty due to manufacturing defects.
    10. For the purposes of this warranty, “consequential, indirect, or incidental damages” shall include, but not be limited to: loss of profits or revenue, loss of business opportunity, cost of replacement goods, downtime costs, loss of data, damage to reputation or goodwill, and third-party claims. The independent third-party assessment shall be conducted by a certified product testing laboratory or qualified industry expert with relevant expertise in the Product category, to be mutually agreed upon by both parties within 28 days of the dispute arising.
  • Any product which is found to be faulty due to abuse, misuse or improper installation will be charged to the Buyer at the Seller’s current hourly rate.
  • The Buyer must inspect the Product within 7 days of receipt and notify the Seller of any visible defects or non-conformities. Failure to do so may result in the Buyer waiving their right to claim for such defects under this warranty.
  • COSMETIC WEAR AND TEAR

Please note that our warranty does not extend to cosmetic wear and tear of the product, including any deterioration of surface coatings. Under no circumstances should caustic or petroleum-based cleaners be used on any part of the light. The use of such substances may compromise the integrity of the lenses and seals, diminish clarity, reduce light output, and cause damage to the powder coating.

Surface Coatings – Our products are finished with a premium-grade, UV-rated powder coating, selected for its exceptional durability under standard environmental conditions. However, damage to the painted surfaces caused by chemical exposure or operation in environments with high salinity will not be covered under warranty.

Lens Damage – The lens materials used in our products are sourced from some of the most reputable manufacturers in the industry. However, exposure to the following chemicals can cause the polycarbonate lenses to become brittle, yellowed, or otherwise degraded:

Acetic Acid (aqueous) / Acetone / Ammonium Carbonate (aqueous) / Ammonium Chloride (aqueous) / Benzene / Calcium Hypochlorite / Chloroform / Chromic Acid (aqueous) / Citric Acid / Ethyl Acetate / Ethylene Glycol (aqueous) / Formaldehyde (aqueous) / Heptane / Hydrofluoric Acid (aqueous) / Lubricating Oils (petroleum-based) / Methyl Ethyl Ketone / Methyl Chloride / Mineral Oils / Oleic Acid / Ozone / Phosphoric Acid (aqueous) / Toluene / Turpentine / Zinc Chloride (aqueous)

To preserve the performance and longevity of your product, please avoid exposure to the substances listed above. Some of the aforementioned chemicals may be present in abrasive automotive and heavy machinery cleaning products. Commonly used brands such as Rain-X® and Armor All® may contain substances that are known to adversely affect the integrity of our product materials. We strongly advise against the use of any cleaning agents containing these chemicals, as any damage resulting from chemical exposure is expressly excluded from warranty coverage.

Our goods are supplied with guarantees that cannot be excluded under the Australian Consumer Law.
